"The way Tennessee law is structured is the courts require you to put in a dollar amount, and the most a jury can give you is the dollar amount you put in your complaint," Gilreath said. "I would actually prefer to not have to state the amount, since that's determined by the jury."
The screening process typically involves a chest X ray that can point to asbestos fibers lodged in the lungs.
Five months after almost 50 employees of the Illinois Central Railroad Co. in Memphis sued the railroad for alleged asbestos exposure, another 24 Illinois Central workers are making the same claim.
Depending on where the railworkers were posted at the IC rail yard, they allegedly would have been exposed to varying amounts of asbestos. It was everywhere from points in the buildings to the brake shoes the railroads use to brake and slow the trains, Gilreath said.

They're joining the previous group of employees who were all past and present Illinois Central workers in each seeking up to $750,000 in a series of lawsuits filed this month in Shelby County Circuit Court. Most of the workers in the second round of suits are from the Mid South, many from Shelby County.
A CN spokesman declined to comment on either the pending litigation that's been in Circuit Court for several months or on the new batch of court filings.

Almost all are retired and once worked at various points in the rail yards, of which Illinois Central had two in South Memphis. The Illinois Central Railroad, once known as the Main Line of Mid America, was bought by the Canadian National Railway in 1998.
That information data, statistics and medical conditions, for example is being broken down by each individual plaintiff. That's because the extent of the alleged exposure and injuries is not the same for everyone involved, which is also a reason the litigation is not part of a class action suit.
Asbestos cases, by their very nature, are complicated affairs. There are very precise timeframes and burdens of proof that must be met, per federal law. And it can be difficult to prove that the poor state of health for an 80 year old retired railroad worker, for instance, was caused by asbestos.
"The reason that we pursue these cases is because we feel like we've got evidence that shows the railroad company had knowledge that asbestos was harmful and they chose to do nothing about it," Gilreath said.

"We're still in the discovery phase, and we'll be there for a while," said Gilreath, whose firm, Gilreath Associates, has offices in Memphis, Nashville and Knoxville. Nearly 70 percent of those workers, the national report concluded, have faced respiratory trouble, and many likely will be sick for the rest of their lives. Another conclusion is that the patients in the study who first traveled to Ground Zero after the Sept. 11, 2001, terrorist attacks likely were exposed to asbestos. The building at 200 Madison Ave., for example, went through an asbestos removal program several months ago to get prepared for the Memphis Regional Chamber's planned relocation to the building, though that move is now on hold.
